Environmental Spill Disaster Devastates Tennessee; 48 Times the Size of Exxon Valdez

The video below is a shocking helicopter-level view of the immense coal ash sludge spill in Tennessee.













An environmental disaster of epic proportions has occurred in Tennessee. Monday night, 2.6 million cubic yards (the equivalent of 525.2 million gallons, 48 times more than the Exxon Valdez spill by volume) of coal ash sludge broke through a dike of a 40-acre holding pond at TVA's Kingston coal-fired power plant covering 400 acres up to six feet deep, damaging 12 homes and wrecking a train.


According to the EPA the cleanup will take at least several weeks, but could take years. Officials also said that the magnitude of this spill is such that the entire area could be declared a federal superfund site.


Toxic Sludge Got Into Tributary of Chattanooga Water Supply

Apart from the immediate physical damage, the issue is what toxic substances are in that sludge: Mercury, arsenic, lead, beryllium, cadmium. Though officials said the amounts of these poisons in the sludge could not be determined on Monday, they could (at the mild end) irritate skin or trigger allergies or (longer term) cause cancer or neurological problems.


This toxic sludge got into the Emory River, a tributary of the Clinch and Tennessee Rivers: The water supply for Chattanooga, Tennessee as well as millions of people living downstream in Alabama, Tennessee and Kentucky. TVA says that as yet the spill (which they are characterizing as a mudslide or landslide, but frankly it's still toxic…) has not affected the water quality in the Emory River.


High Levels of Rain, Thaw Freeze Cycles May Have Weakened Pond Walls

On why the spill happened, the Tennessean speculated,

The area received almost 5 inches of rain this month, compared with the usual 2.8 inches. Freeze and thaw cycles may have undermined the sides of the pond. The last formal report on the condition of the 40-acre pond -- an unlined, earthen structure -- was issued in January and was unavailable Monday, officials said.


Greenpeace Calls for Criminal Investigation

In a press release issued yesterday, noting that spills of similar substances have resulted in felony charges, Greenpeace called for a criminal investigation into the spill:

"Every facility like this is supposed to have a spill contingency plan to prevent this kind of disaster," said Rick Hind, Greenpeace Legislative Director. "The authorities need to get to the bottom of what went wrong and hold the responsible parties accountable.
"

TVA Releases Official Statement

In an official statement, TVA president and CEO Tom Kilgore said,

Protecting the public, our employees, and the environment is TVA's primary concern as we supply electric power for the people of Tennessee Valley region. We deeply regret that a retention wall for ash containment at our Kingston Fossil Plant failed, resulting in an ash slide and damage to nearby homes.


We are grateful no injuries have been reported, and we will take all appropriate actions to assist those affected by this situation.


We appreciate the continuing efforts of local and state agencies, as well as TVA employees, to respond to this situation quickly and efficiently. Our intense effort to respond effectively will continue 24/7 for the foreseeable future with the safety of the public our top priority.



Clean Coal, Yeah Right





As many people in the blog world are noting, it's this sort of thing that really makes the proposition of clean coal so absurd. Even if you can scrub all the CO2 out of it, you still have so many other toxic waste products associated with burning coal that have to be stored that carbon emissions are just a part of the problem.

On Friday, December 19, 2008 Mumia filed his appeal to the United States Supreme Court asking it to consider his case for a new GUILT PHASE trial. That would mean a new trial that could lead to Mumia's release, rather than simply a SENTENCE trial that could only lead to life in prison or execution.

Last month, the Philadelphia District Attorney filed its appeal to have Mumia executed without even a new sentencing phase trial where he might be sentenced to life in prison.

Simmering social and material tensions in Greece were detonated by the police killing of 15-year-old Alexandros Gregoropoulos earlier this month on December 6th. The past three weeks have seen daily and nightly tumultuous clashes between those rising up and the Greek state. Demonstrations, protests, barricades, and riots have rocked the streets. TV stations, universities, high schools, workplaces, and city halls---overall hundreds of institutions---have been occupied.

Last Saturday was an international day of solidarity with the Greek uprising. Labor and student demonstrations are scheduled to continue early in the new-year.

Nikos Raptis is a resident of Athens and also a long-time contributor to Z, which happens to be named for the Costa-Gavras film, also titled Z, that is about resistance and repression in post-war Greece. Raptis's article, "Greek Teenagers," provides background to the uprising. Z collective member Chris Spannos interviewed Nikos for an update on the current status of the revolt. The interview took place between December 17-23.

The Greek Populace

Chris: First, moving into the third week of rebellion, can you give an overview of events this week and into the foreseeable future? What is the mood of those protesting and of broader society more generally?

Nikos: Chris, allow me, before we go ahead with the interview, to make a few comments on the mood that I [or any other person] find myself in these days. For example, in the morning of December 18 I read in the news:

First: In the New York Times of December 17 we read: "Jose and his brother Romel [two Ecuadorian immigrants] appear to have been misidentified as gay as they walked home, arms around each other, on a predawn morning in the Bushwick section of Brooklyn. Romel managed to escape the three men who emerged from a passing car wielding a baseball bat and shouting anti-gay and anti-Latino epithets.

Jose was struck on the head with a bottle, then kicked and beaten into unconsciousness... and expired last Friday night, one day before his mother, who was traveling from Ecuador, could reach him".

Second: In today's Greek press we read: Alexis Gregoropoulos, the 15-year-old Greek, was murdered by a Greek policeman on December 6. Yesterday, 12 days after the murder of Alexis, around 11 am, a group of about 10 high school kids, members of the Coordinating Committee of their school, were assembled at an open public space at Peristeri [a rather downgraded part of Athens] discussing the program for the demonstrations of the next day. A shot was fired from some distance and a 17-year-old kid was hit on the palm of his right hand. The kid was operated upon this morning and a 38-caliber revolver bullet was extracted. According to the other kids a second shot was fired 10 minutes later from a closer distance.

Introduction Mumia Abu-Jamal remains on Pennsylvania's death row. Last week marked the 27th anniversary of his unjust imprisonment. Racism, fraud and politics have been threads that have run through the case since its inception, and continue today.




We are in extensive litigation on two fronts before the United States Supreme Court. The prosecution is continuing it quest for the execution of my client. In a separate case before the court, I am seeking an entirely new trial and Mumia's freedom. Based upon my experience in having successfully represented numerous people in murder cases involving the death penalty, I am convinced that we can win if I can just get it back before a jury.

Supreme Court The following is a brief overview of recent developments and filing deadlines:

Beard v. Abu-Jamal, U.S. Sup. Ct. No. 08-652 On November 14, 2008, the Philadelphia District Attorney filed in the U.S. Supreme Court a petition seeking to overturn the victory we achieved earlier this year in the U.S. Court of Appeals for the Third Circuit. Abu-Jamal v. Horn, 520 F.3d 272 (3rd Cir. 2008). In that ruling court ordered a new jury trial on the question of the death penalty. Our Brief In Opposition is scheduled to be filed on January 21, 2009.




Abu-Jamal v. Beard, U.S. Sup. Ct. No. 08A299 The Petition for Writ of Certiorari will be filed on December 19, 2008. The issues concern the prosecution's use of racism in jury selection. Relief was denied last spring by a sharply divided federal court. This is of great constitutional significance as reflected by the extraordinary dissenting opinion of Justice Thomas L. Ambro. Abu-Jamal v. Horn, 520 F.3d at 304-320. He reaffirmed the bedrock principle that everyone is entitled to a fair and impartial trial by a jury of his or her peers, and that excluding even a single person from a jury because of race violates the Equal Protection Clause of the U.S. Constitution's Fourteenth Amendment.

Dog's Throat Slashed; Dumped by Road

A gruesome and heartbreaking story out of Chickasha. A man finds a dog, dead inside a kennel with it's throat slashed dumped onto his property. Authorities aren't sure at this point why someone would brutally kill an innocent dog, and then just throw it on the side of the road like a bag of trash. Some think that this incident could be part of a bigger problem.


Karen Brady, a reporter for the Chickasha Express-Star said, "There was a blue zipper collapsible animal with a white pitbull in it.
"

The remains of an inhumane act is left on the side of a man's rural property in west Chickasha. Karen Brady with the Chickasha Express-Star took a picture of the dog which was bloodied, and wrapped in a blanket.


"It was kind of sickening, the gore of it. Plus just the fact that someone could do that to an animal. As an animal lover it offended me horribly," Brady explained.


The police report says the pitbull had it's throat cut, and was possibly beaten in the head with a blunt object.


"There was very little blood at the scene, so it probably happened somewhere else and this is where the dog was dumped out," said Chickisha Police Chief Lynn Williams. "If the dog was tortured the way it could've been, then it is a felony in the state of Oklahoma.
"

Cynthia Armstrong with the Humane Society of the United States says this case may go even deeper. After seeing noticeable scars and wounds she says it may have been involved in dog fighting.


"It's scary that someone would be so brutal to an animal," said Cynthia Armstrong the Oklahoma State Director for the Humane Society of the United States.
"This pitbull victim could be a loser in a dogfighting match, was killed, and dumped.
"


The humane society will offer a $2,500 reward for tips that will lead to a conviction in this case, and a $5,000 reward for helping put a dog fighter behind bars.


"There's not a lot that we have to work with right now, and that's what i would ask is that if anyone knows anything about what happened to the dog or how it wound up there to go ahead and give us a call," Chief Williams described.


"These brutal acts that are committed against dogs and cats. These folks are usually involved in other crimes, they're usually involved in some kind of domestic violence or child abuse," Armstrong concluded.

Officials say if you have a pet and can't or don't want to care for it anymore take it to your nearest animal shelter. They will accept your pet, but do not leave it on the side of the road because that is a crime. The person responsible for killing this pitbull could face a felony charge with fines up to $5,000 and up to 5 years in the state penitentiary.

Government of Canada Calls for Removal of Sea Shepherd Conservation Society President Paul Watson


OTTAWA, ONTARIO--(Marketwire - Dec. 8, 2008) - Comments made by Sea Shepherd Conservation Society (SSCS) President Paul Watson regarding the humane harvest by Inuit hunters of narwhals trapped in ice near Pond Inlet, Nunavut, have crossed the line beyond reasonable dissent.


The offensive commentary written by Mr. Watson equates this humane harvest with the killing of civilians during the Vietnam war. It represents an invective against Inuit that has nothing to do with conservationist principles. These deeply hurtful remarks reveal an extremism that is unacceptable in our society, and we call for an immediate apology and retraction of these comments. The Sea Shepherd Conservation Society should as well immediately remove Mr. Watson as their president.


The Inuit people are closely connected to their environment and have been for centuries, and will continue to practice their great culture. Inuit strongly believe animals should be respected and should never suffer as in this case. Mr. Watson's comments demonstrate a deep ignorance of Inuit society, and seek to demonize their culture and traditions. His extreme comments discredit the Sea Shepherd Conservation Society, which he represents. These comments are deeply offensive to Inuit, and to all Canadians.


The irresponsible comments made by Paul Watson are proof that Mr. Watson's leadership as president of a conservationist movement should end immediately.

This is Captain Paul Watson's response.


I have absolutely no intention of apologizing for or retracting my criticisms of the cruel and unnecessary massacre of 560 defenseless Narwhals by Inuit riflemen on the orders of the Canadian government. I also have no intention of resigning.


The slaughter of these Narwhals did not need to take place. The Humane Society offered to employ Inuit to keep the breathing holes open until a Canadian government icebreaker could arrive to break them out. The Canadian government refused to dispatch an icebreaker stating that the noise of the icebreaker would "stress" the whales.


There was nothing humane about the slaughter that followed as Inuit riflemen opened fired on the frightened whales. The "stress" of an icebreaker would have been minimal compared to the horrific trauma of having family members torn apart by bullets around them. There is no humane way to shoot a whale. For the DFO to describe this slaughter as "humane" is ludicrous but then again not unexpected from a government that describes the skinning of a baby harp seal alive as "humane.
"

The use of the word "harvest" also illustrates the callousness and insensitivity of the DFO. These whales were not "harvested", they were shot in cold blood like fish in a barrel. These are endangered species and the responsibility of the government of Canada should have been to do everything possible with the resources available to them to save these animals. They did not.


This is the same DFO that spends millions of dollars each year providing icebreakers to the Canadian sealers to break paths through the ice to kill seal pups. There is no excuse for their refusal to break these Narwhales out of the ice.


I said nothing hateful about Inuit culture. My criticism was for the behavior of those individuals who slaughtered 560 Narwhals when it was possible to rescue them. I maintain that the slaughter was barbaric, cruel and unnecessary. I make no apologies for that. I could not care less what race or culture these men belonged to - it was their behaviour that I condemned and I maintain that it was a viciously cruel way to execute the orders of the government of Canada.


Our clients are whales and other marine wildlife. We represent their interests and not the interests of people of any culture, of any race, of any belief. We do not discriminate on our criticisms of human culture. The defense of life, diversity and the ecological health of this planet takes precedence over any culture. I am frankly sickened by the continued use of culture to justify everything from bullfights to fox hunts, to polar bear hunting to whaling to cutting down the rainforest.


My empathy is for hellish horrific pain, suffering and loss borne by the Narwhals. They are after all the First Nations. They were there before any of us and humankind has waged bloody war on the First Nations for far too long.


And in this war between our species and the others, (non-human sentient citizens of the planet) I side most passionately with them against us, a proud traitor to my species and every whale I can save from the clutches of death at human hands is a victory.


As for my comments being offensive to ALL Canadians, that is certainly not true. I am a Canadian and I know hundreds of others Canadians who were not offended, who in fact supported my comments and most importantly my comments were not offensive to the memory of the 560 Canadian Narwhals who died under a hail of bullets.


The Canadian government could have rescued those whales, if they had the political will to do so. They did not, so they let Inuit riflemen act as the executioners of their cold-hearted bureaucratic decision.


I fault the Canadian Department of Fisheries and Oceans first, the riflemen second and the Inuit culture not at all. This was a crime perpetuated by individuals with the consent of government and in this case my comparison with the slaughter of civilians at MyLai, Vietnam does differ. The slaughter at MyLai in 1968 under the orders of Lt. William. Calley was not done with the consent of the U.S. government.


I grieve for those whales and it is I who demand the resignation of Gail Shea for so cold bloodedly ordering the execution of these whales. The blood is on her hands and her government. It is she who should apologize and it is she who should resign. Not I.

A Message to the Music Industry from the Lead Singer of the Kingsmen

Stop Sobbing About Free Music Downloads

My name is Jack Ely and I'm the one whose voice is heard daily on The Kingsmen's 1963 recording of Louie Louie, (may it rest in peace) so you know I have some music business experience.

First I'd like to express an opinion that probably will not be very popular but which oozes with truth. In the early '60's when I was recording, records were thought of as a tool to help promote live performances. The live performances were the main revenue stream and the records were just promotional tools to get people to come see the shows. Somewhere this mode of thinking got turned upside down. Consequently in years hence, record companies, producers, et. all, have made recordings, hoping to profit from the sale of those recordings alone, regardless of whether or not the artist could ever pull it off live. This did some things to the music business that weren't very healthy. First it made available to the general public, music of artists who may or may not be good live performers; almost anyone can make a good recording with enough cut-ins and loops. And... it made music by groups of players who never ever intended to perform that music live, and who may or may not have ever been able to get along with each other long enough to really sustain any kind of a road show.

Music is meant to be played for the enjoyment of the audiences. For instance, if I go into the studio with an acoustic guitar and simultaneously play and sing on a recording, people would come to see me perform in that same mode; I.e. playing guitar and singing as a solo act. I don't think they would come to see me expecting a full band. Conversely, if I advertised a 'Night with Louie Louie" people would come expecting to see a rock band that they could dance to, and would be quite disappointed if I showed up with just my acoustic guitar.

The suggestions that recordings are produced today just to sell recorded music is all backwards and the sooner the record companies and producers and artists figure this out the sooner they will all quit sniveling over the fact that the entire world is freely sharing their music digitally and isn't willing to stop; and in fact will do anything to circumvent their efforts to get paid for the recordings alone.

The days of producers and musicians putting bands together just to get a recording deal so they can get paid by the record company for a product that usually never even gets released; those days are over.It's time record companies went back to their roots and became what they started out to be; entities who record working acts in order to

1) capture the performance for posterity, and

2) make a promotional tool to get audiences to the next show.

The solution is to give the world all the free music it wants, but to give the recording entity, whether it be a record company or a producer, or whomever, a cut of every live performance. That will do at least two things and maybe more that I haven't even thought about yet. First it will give everyone involved in the recordings a source of revenue (pay day) for all their hard work of producing and promoting the recordings. Second, it will weed out all the so-called "recording artists" who couldn't, in a live venue, perform their way out of a paper bag. In a down economy the public craves live entertainment, so what better time to get back to basics. The timing couldn't be better for a profitable turn around. So now is the time to get it going.

I send you these thoughts in hopes that just maybe a new/old perspective on the subject of recorded music can be presented to the entire recording world and they can all start making a real profit.
